Adoption Law of the People's Republic of China (Order No. 10 of the President of the People’s Republic of China) According to the first paragraph of Article 15, the adoption shall be registered with the civil affairs department of the people's government at or above the county level. The adoptive relationship shall be established as of the date of registration. Measures for Registration of Adoption of Children by Chinese Citizens (Decree No. 14 of the Ministry of Civil Affairs) According to the first paragraph of Article 3, where an abandoned infant, child or orphan who is reared by a social welfare institution and whose biological parents cannot be identified or found is adopted, registration shall be carried out with the adoption registration organ in the locality where the social welfare institution is located. Measures on the Registration of Adoption of Children by Foreigners in the People's Republic of China (Decree No. 15 of the Ministry of Civil Affairs) According to Article 9, foreigners attempting to adopt a child in China shall enter into a written adoption agreement with the person placing out the child for adoption. The agreement shall be in three copies, one is kept by the adopter, one is kept by the person placing out the child for adoption, and the third one is kept by the adoption registration organ while undergoing adoption registration procedures. After the conclusion of the written agreement, the parties concerned shall both register the adoption with the civil affairs department of the people's government of a province, an autonomous region or a municipality directly under the Central People's Government in which the adoptee's permanent registered residence lies. Regulations on the Jurisdiction of Registration of Adoption of Children by Overseas Chinese and Chinese Citizens Living in Hong Kong, Macao and Taiwan and Required Certificates and Supporting Materials (Decree No. 16 of the Ministry of Civil Affairs) According to Article 2, to adopt a child in the Mainland, an overseas Chinese or a Chinese citizen living in Hong Kong, Macao or Taiwan shall apply for registration of the adoption with the civil affairs department of the people's government of a municipality directly under the Central People's Government, a city divided into districts or an autonomous region in which the adoptee's permanent registered residence lies. Standards for Registration of Adoption (Order No. 118/2008 of the Ministry of Civil Affairs) According to the first paragraph of Article 1, adoption registration authorities are civil affairs departments of the people's governments at all levels that perform the administrative functions of adoption registration according to law. According to Article 2, an adoption registration authority shall perform the following functions: (1) To handle adoption registrations; (2) To handle cancellation of adoption registrations; (3) To repeal adoption registrations; (4) To re-issue certificates of adoption and adoption relationship cancellation certificates; (5) To issue adoption relationship certificates; (6) To handle announcements on looking for biological parents of abandoned babies (abandoned children); (7) To establish and keep adoption registration records; and (8) To popularize adoption laws and regulations.

Business description (1) Procedures: A adoption-involved party files an application for adoption registration in Shanghai, whether in a Hong Kong, Macao or Taiwan involved case, in an overseas Chinese case or in a foreign case, or for an abandoned child (infant) or orphan who is reared by the municipal children’s home, Shanghai Marriage (Adoption) Registration Center will conduct fact to fact inquires with respect to the adoption registration matters, determine the intent of the parties concerned to establish the adoption relation, and review, within the required period, the written materials submitted by the applicant. If the conditions set out in the Adoption Law are met, it will register the adoption for the parties concerned and issue the certificate of adoption, whereby the adoption relation will be effective from the date of registration. If the conditions set out in the Adoption Law are not met, it will reject to register the adoption and state the reasons for refusal with the parties concerned. (2) Method of review: Face to face inquiry and written review. 2. Applicable scope Applicable to the application for and handling of adoption registration.
