Marriage Law of the People's Republic of China According to Article 8, the man and woman who apply for marriage shall go to the marriage registration authority in person to get registered. If they meet the requirements of this Law, they shall be registered and be given a certificate of marriage. The obtaining of a certificate of marriage means the establishment of the relationship of husband and wife. Those who live as husband and wife without registration shall go through remedial registration procedures. According to Article 35, if, after divorce, both parties desire to resume their husband-and-wife relationship, they shall go through the registration procedures at the marriage registration authority. Regulation on Marriage Registration According to the second paragraph of Article 2, the organ in charge of marriage registration for the marriage between a Chinese citizen and a foreigner, or between a mainland citizen and a citizen of the Hong Kong Special Administrative Region (hereinafter referred to as a Hong Kong resident), a citizen of the Macao Special Administrative Region (hereinafter referred to as a Macao resident), a citizen of the Taiwan Region (hereinafter referred to as a Taiwan resident) or an overseas Chinese, shall be the civil administration department of the people's government of the province (autonomous region, municipality) or the organ fixed by that department. According to the second paragraph of Article 4, for the marriage in China's mainland between a Chinese citizen and a foreigner, or between a mainland citizen and a citizen of Hong Kong, Macao, Taiwan, or an overseas Chinese, the man and the woman shall appear together to go through the marriage registration at the marriage registration organ in the locality where the mainland citizen has his / her residence registration.

Business description (1) Procedures: Shanghai Marriage (Adoption) Registration Center administratively affirms the application for marriage (restoration of marriage) filed by the applicant, orally inquires about the desire of both parties concerned and carries out formal review over the required certificates and supporting materials according to the site procedures. Then, in accordance with the regulations of PRC on marriage registration, it will decide to permit or reject the application for marriage registration on site. If it is permitted, the basic information of the parties concerned will be input in the national marriage registration system, and the marriage certificates will be produced, signed and issued on site.
